Wills ensure that your wishes as to how you want your assets to be distributed after your death are carried out.
If you die without a Will, the rules of Intestacy will apply and must be followed by your loved ones. These rules set out who will receive your assets and how the assets will be distributed. Your Will, will provide your family with a clear set of instructions about how you want your assets to be divided and it can be used to protect against litigation against your Estate.
Testamentary Trust
In some instances, a Testamentary Trust is not enough to protect your assets upon your death and you may need to look at drawing a Testamentary Trust. This will ensure that the persons receiving a benefit under your Will are receiving them in a tax effective manner and it can also ensure that parties that are non-linear family members cannot access the assets. These Wills are sometimes called blood line Wills.
